This website is operated by Niche Nailss. Throughout the site, the terms “we”, “us” and “our” refer to Niche Nailss. Niche Nailss offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy: REFUND POLICY
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of United Kingdom.

BOOKING WITH NICHE NAILSS

Please ensure to provide a 48-hour prior notice if you need to reschedule your appointment. Appointments rescheduled after this timeframe will be subject to cancellation, requiring a new booking along with a non-refundable booking fee.

When requesting a cancellation, kindly do so at least 48 hours before your scheduled appointment. If you choose to cancel beyond this timeframe, a new booking fee of ≈£20 will be required for your next appointment.  A fee of £35 will be charged to your card if you don’t show up to your appointment with no communication .

The remaining balance must be paid in CASH.

Out of hour appointments cost an additional £20.

LATE ARRIVALS

A late fee will be applied to clients who are between 10 and 20 minutes late. Clients who are 20 minutes late = cancellation & will have to book a new appointment.

Failure to comply with any of the mentioned policies will lead to being unable to book in future.

NAIL HEALTH

Nails must be completely natural when attending an initial appointment (no gel/builder enhancement).

I don't work over other people's work.

If you arrive to your appointment with enhancements and have failed to inform me or book in for a removal, I have the right to refuse service.

By booking with Niche Nailss you are agreeing to all the policies listed above.

 

NANOBLADING 

Lateness Policy

Typically, I am fully booked with no flexibility for lateness. • If you arrive more than 15 minutes late, your appointment will need to be rescheduled, and a 50% charge will apply. • Please do not arrive more than 10 minutes early, as I will be with another client and unable to answer the doorbell.

Rescheduling & No-Shows 

To reschedule, this must be done outside of 48 hours’ notice or within 48 hours’ notice using the confirmation email from when you first booked your appointment. • You can contact me directly if you struggle with this. Thank you. • No-shows will result in the loss of your appointment.

Location Details (Important Information) 

I am based at Containerville on The Oval , Corbridge Crescent. – Studio 75 , Top Floor. There are TWO Containerville sites: 1. Emma Street (not my location) 2. Corbridge Crescent (My Location) Ensure you enter the correct postcode when using maps or navigation apps. Arriving at the wrong location will be considered lateness. Please plan your journey carefully.

Pre-Care, Healing Process, & Aftercare

By booking, you confirm that you have read, understood, and agree to follow: 1. Pre-Care Guidelines – To prepare properly for your appointment. 2. Healing Process Information – To understand how your skin will heal and what to expect. 3. Aftercare Instructions – To ensure optimal results and proper maintenance. All guidelines are detailed on my website. You agree to plan your schedule around the healing process to ensure the best results.

Retouching for Cosmetic Tattoos 

Cosmetic tattoos may require retouching, which is common and perfectly normal. • The skin can break down pigment differently depending on individual skin types, lifestyle, and aftercare. • Retouches are offered at a minimal charge of £95, with pricing details available on my website. • By booking, you acknowledge that a retouch may be necessary to achieve your desired results.

Contraindications 

Before booking, please review the following contraindications. If any of these apply to you, do not proceed with booking. Concrete Contraindications to Cosmetic Tattooing 1. Under 18 Years of Age: Individuals must be 18 or older to undergo cosmetic tattooing. 2. Pregnancy: If you find out you are pregnant after booking, we can reschedule your appointment with no expiry on the rescheduling date. 3. Chemotherapy or Radiation Therapy: Those currently undergoing cancer treatments should wait until their treatment has finished and they are fully healed. 4. Accutane Use: You must wait three months after completing an Accutane course before proceeding with cosmetic tattooing. 5. Heart Conditions or Pacemaker: Individuals with serious heart conditions or pacemakers should avoid cosmetic tattooing. 6. Blood Disorders: Conditions such as hemophilia or other blood disorders may increase the risk of complications. 7. Blood-Thinning Medications: While permitted, please note that results may not be as good due to the possibility of excessive bleeding. 8. Skin Conditions: Active skin diseases such as psoriasis, eczema, or undiagnosed rashes/blisters in the treatment area can affect results. 9. Keloid Scarring: Individuals prone to keloid or hypertrophic scarring should avoid cosmetic tattooing. 10. Glaucoma: Those with glaucoma may face increased risks during procedures involving the eye area. 11. Autoimmune Diseases: Conditions like lupus or multiple sclerosis may affect healing and pigment retention. 12. Epilepsy or Seizure Disorders: You can proceed, but please inform me if you have a history of epilepsy or seizure disorders. 13. Recent Cosmetic Procedures: Wait at least 4 weeks after Botox or filler injections before having permanent makeup. 14. Recent Surgery: • Body Surgery: Wait a few weeks until you are fully healed. • Face Surgery: Wait a few months until you are fully healed. 15. Lash/Brow Growth Serums: Discontinue use of lash or brow growth serums at least 4 weeks before the procedure. If any of the above conditions apply to you, please do not proceed with booking. Your safety and well-being are my top priorities. If you have any questions or require further clarification, feel free to contact me before scheduling your appointment.

Agreement

By scheduling your appointment, you agree to all terms and conditions above, including the style of work, lateness policy, cancellation and no-show policy, location information, pre-care, healing process, aftercare guidelines, retouching policy, and requirements for clients with previous work.

Attending your appointment.

Under NO circumstances are children or pets to be brought into the studio during a NANOBLADING appointment. If you do arrive with a child or a pet the appointment will need to be rebooked at additional cost due to time wasted.

 

Niche Nailss Academy

Terms & Conditions — Academy Section

The following terms and conditions apply specifically to all bookings made with Niche Nailss Academy, including the 1-1 Professional Nail Tech Course and associated course kits. These terms form part of the overarching Niche Nailss Terms & Conditions.

1. Booking & Payment

1.1  A non-refundable booking fee of 25% of the total course price is required at the time of booking to secure your place. Your booking is not confirmed until this fee has been received.

1.2  The remaining balance must be paid in full no later than 14 days before your course date. Failure to pay by this deadline may result in your place being released without refund of the booking fee.

1.3  All remaining balances are to be paid in cash on or before the course date unless otherwise agreed in writing.

1.4  Prices are subject to change. The price confirmed at the time of booking will be honoured.

2. Cancellations & Rescheduling

2.1  The booking fee is non-refundable under all circumstances, including cancellations made by the student.

2.2  Students may request to reschedule their course date free of charge, provided a minimum of 21 days’ notice is given prior to the original course date. Rescheduling requests made with less than 21 days’ notice may not be accommodated and the booking fee will be forfeited.

2.3  Each student is entitled to one reschedule only. Further reschedule requests will not be accommodated and the original booking fee will be forfeited.

2.4  No-shows on the day of the course will forfeit their booking fee and any balance paid. No refund or credit will be issued.

3. Cancellation by Niche Nailss Academy

3.1  In the unlikely event that Niche Nailss Academy must cancel or postpone a course due to illness, emergency, or circumstances beyond our control, students will be offered a full refund or the option to reschedule to the next available date.

3.2  Niche Nailss Academy is not liable for any travel, accommodation, or other costs incurred by the student as a result of a cancellation.

4. Course Kits

4.1  Course kits are non-refundable once dispatched or handed over to the student.

4.2  Kits are provided as described at the time of purchase. Contents may vary slightly depending on stock availability, and equivalent substitutions may be made where necessary.

4.3  Students who have not purchased a kit may enquire about adding one up to 7 days before their course date, subject to availability.

5. Attendance & Models

5.1  Students are required to arrive on time on both days of the course. Late arrivals may not be accommodated, and no refund will be issued in this circumstance.

5.2  Students must arrange their own model to attend Day 1 of the course. The model must be 18 years of age or older and willing to have nail services applied. Failure to bring a model may affect your ability to complete required assessments.

5.3  If you are unable to source a model, you must notify Niche Nailss Academy no less than 7 days before your course date. We may be able to assist with sourcing a model at an additional fee, subject to availability. This cannot be guaranteed.

5.4  No guests or additional visitors are permitted at the studio during the course.

6. Certification & Coursework

6.1  To receive your Niche Nailss Academy certificate (accredited by The Beauty Professionals), students must complete all required coursework, including 2 post-course submissions with photographic evidence.

6.2  Certificates will only be issued upon successful submission and approval of all coursework. Niche Nailss Academy reserves the right to withhold certification where requirements have not been met.

6.3  Coursework must be submitted within a reasonable timeframe following the course. Extensions may be requested but are at the discretion of Niche Nailss Academy.

7. Intellectual Property

7.1  All course materials, including but not limited to the Nailed It ebook, workbooks, lesson content, and digital resources, are the intellectual property of Niche Nailss Academy and are provided for personal professional development only.

7.2  Students must not reproduce, resell, share, or distribute any course materials in any format without prior written consent from Niche Nailss Academy.

8. Photography & Social Media

8.1  By attending the course, students consent to photographs and videos being taken during the session for use on Niche Nailss Academy’s social media platforms and marketing materials.

8.2  Students who do not wish to be photographed or filmed must notify Niche Nailss Academy in writing prior to their course date.

9. Health & Safety

9.1  Students must disclose any known allergies, skin sensitivities, or medical conditions relevant to nail treatments prior to attending the course.

9.2  Niche Nailss Academy reserves the right to refuse participation if a student is deemed unfit to take part safely.

9.3  Students are responsible for their own health and safety during the course and must follow all instructions given by the trainer.

10. Conduct

10.1  Niche Nailss Academy expects all students to conduct themselves respectfully towards the trainer, any models, and fellow attendees. Disruptive or inappropriate behaviour may result in removal from the course without refund.

11. Liability

11.1  Niche Nailss Academy’s liability is limited to the course fee paid. We are not liable for any indirect or consequential losses arising from attendance or non-attendance.

11.2  Niche Nailss Academy is not responsible for any loss, damage, or theft of personal belongings brought to the studio.

12. Governing Law

12.1  These terms and conditions are governed by the laws of England and Wales.
